Consumer rights & Australian Consumer Law

Our services are supplied in Australia and are subject to the Australian Consumer Law (ACL). Certain guarantees under the ACL cannot be excluded, including that services will be provided with due care and skill and be reasonably fit for purpose.

Where a consumer guarantees apply, our liability for breach is limited to remedies permitted under the ACL. For non-consumers (businesses), to the maximum extent permitted by law, our liability is limited as set out in the Liability section below.

Limitation of liability

Except for any liability that cannot be lawfully excluded under the ACL, Nextmember's total liability for any claim arising out of or related to our services is limited to the amount paid by you for the specific services giving rise to the claim in the 12 months preceding the claim.

Exclusions

  • We are not liable for indirect, consequential, or special losses.
  • We are not liable for delays caused by third-party dependencies.

When liability applies

Liability will apply where required by law and proportionate to the breach. We maintain professional indemnity and public liability insurance appropriate for our operations.

Refunds, warranties and services

Our design services are delivered in stages. Refunds or credits are considered on a case-by-case basis, consistent with our engagement terms and statutory rights.

We warrant that services will be provided with due skill and care. Any project scope, deliverables and timelines are documented in our engagement agreement. Revisions beyond agreed scope may incur additional fees.

Refunds are provided only where required by law or as expressly agreed. If a refund is approved, it will be processed within 30 days. Any third-party costs already incurred may be deducted.

Where a service fails to meet agreed acceptance criteria, we will use reasonable efforts to rectify the issue. Credits may be offered at our discretion where remediation is not practicable.
Design assets

Intellectual property

Unless otherwise agreed in writing, Nextmember retains ownership of pre-existing materials, tools, templates and design systems. Upon full payment, you are granted a licence to use final deliverables for the agreed purpose.

Clients must ensure they have rights to any third-party materials they provide. You grant us a licence to use materials you supply as necessary to provide the services.

Privacy & personal information

We collect and handle personal information in accordance with our Privacy Policy. Personal data collected for service delivery is processed lawfully and retained only as necessary.

Access

You may request access to or correction of your personal information.

Security

We implement reasonable measures to protect data against unauthorised access.

Dispute resolution & governing law

If a dispute arises, please contact us promptly via the details on this page so we can attempt to resolve it amicably. If unresolved, disputes will be governed by the laws of Victoria, Australia and subject to the exclusive jurisdiction of Victorian courts, except where the ACL requires otherwise.
